Terms of Service

The service
Ferguson provides AI-assisted landing page audits. You submit a URL; we fetch the page, analyse it against a set of conversion criteria, and return a written report with a score, identified issues, and suggested fixes. Reports are generated by a large language model and represent considered observations — not guarantees of any commercial outcome.
Your account
You must create an account to use Ferguson. You are responsible for keeping your login credentials secure and for all activity that takes place under your account. We reserve the right to suspend or terminate accounts that breach these terms.
Credits and audit packs
Audits are denominated in credits. One credit is consumed each time Ferguson runs a fresh analysis via the language model. Cache hits — where an identical URL has recently been analysed — are free and do not consume a credit. Credits are non-transferable and apply only to the account under which they were purchased. Subscription credits reset monthly on your billing date; one-off pack credits do not expire.
Refund policy
Audit packs: a full refund will be issued on request provided no credits from the pack have been consumed. Once any credit has been used, the pack is considered partially fulfilled and no refund is available for the remaining unused credits. To request a refund, email hello@useferguson.com with your order reference and we will process it within five business days. Monthly subscriptions: you may cancel at any time. Your subscription remains active until the end of the current billing period; we do not issue partial-month refunds for subscription plans.
Acceptable use
Ferguson analyses publicly accessible web pages. You may submit any publicly available URL, including pages belonging to competitors or third parties, provided you do so in good faith and in compliance with applicable law. You must not use Ferguson to analyse pages for the purpose of phishing, fraud, harassment, or any other unlawful activity. You must not use automated or bulk submission to systematically scrape, harvest, or resell report data without our prior written consent. We reserve the right to refuse or terminate service at our discretion.
Accuracy and limitations
Ferguson's reports are produced by an AI model and are provided for informational purposes only. They do not constitute legal, financial, or professional marketing advice. Observations are based solely on content visible in the page's static HTML at the time of the audit; JavaScript-rendered content, A/B test variants, and personalised experiences may not be reflected. You should exercise your own judgement before acting on any recommendation. In particular, Ferguson's reports do not constitute regulatory compliance advice. Pages operating in regulated industries — including financial services, healthcare, legal services, and gambling — may be subject to mandatory disclosure requirements and copy restrictions. You are solely responsible for ensuring that any changes made in reliance on a report comply with all applicable regulations, including those of the FCA, MHRA, SRA, UKGC, ASA, or any equivalent body. Do not remove or alter mandatory regulatory language — such as risk warnings or eligibility disclaimers — on the basis of conversion advice alone.
Limitation of liability
To the fullest extent permitted by law, Ferguson's total liability to you for any claim arising out of or in connection with these terms or your use of the service shall not exceed the total amount you have paid to Ferguson in the three months immediately preceding the claim. Ferguson shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, or loss of business opportunity, even if advised of the possibility of such damages. In particular, Ferguson makes no warranty that implementing any recommendation in a report will improve conversion rates, revenue, or any other commercial metric. Results will vary by page, audience, and circumstance. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.
Intellectual property
You retain ownership of any content you submit for analysis. The reports generated by Ferguson are yours to use as you see fit. We retain the right to use anonymised, aggregated data from audits to improve the service.
Availability
We aim to keep Ferguson available at all times but make no guarantee of uninterrupted service. We are not liable for losses arising from downtime, delayed reports, or service interruptions.
Service discontinuation
If we decide to close Ferguson permanently, we will give all registered users at least 60 days' written notice by email. Your account will remain fully functional throughout the notice period. Users holding unused prepaid credits purchased via an Audit Pack at the time of closure may request a refund for those credits by emailing hello@useferguson.com within 30 days of the closure date. Monthly subscription credits are not separately refundable on discontinuation — subscriptions will be cancelled from the notice date with no further charges.
Changes to these terms
We may update these terms from time to time. Material changes will be communicated by email to registered users. Continued use of the service after changes take effect constitutes acceptance of the revised terms.
Governing law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
